Welcome to MyWay.kg (the "Platform"). By accessing our website, submitting booking requests, or using our services, you agree to be bound by these Terms of Service. Please read them carefully before finalizing any request.


1. Scope of Service & Platform Role

1.1 The Role of MyWay

MyWay.kg operates strictly as a tourism and transport aggregator platform. We vet, select, and connect international travelers with independent local service providers, transport operators, drivers, guides, and agencies (collectively referred to as "Partners").

1.2 Service Agreements

When you make a booking request on MyWay.kg, you acknowledge that the contract for the actual delivery of the service (the ride, the car rental, the ski guiding, etc.) is directly between you and the assigned Partner. MyWay acts as an intermediary responsible for platform management, partner quality curation, customer service coordination, and payment processing.


2. Booking, Confirmation, and Prepayment Workflow

2.1 Booking Requests

All submissions made through our booking forms are considered Requests, not instant or guaranteed bookings.

The Confirmation Sequence
  1. You submit your request detailing your route, dates, and requirements.
  2. MyWay manually verifies availability with our Partner network and checks regional factors (such as mountain road passability and seasonal closures).
  3. If available, MyWay will issue a provisional confirmation and provide a secure payment link.
2.3 Prepayment Requirement

To fully secure and guarantee your booking, a prepayment (deposit or full amount, depending on the service) must be paid within the timeframe specified in your provisional confirmation email. If prepayment is not received, the request will automatically expire, and the Partner will be released.


3. Specific Service Policies

  • Vehicle Assignment: While we request specific vehicle classes, final assignments depend on local availability.
  • Luggage Capacity: Travelers must accurately declare oversized luggage (e.g., ski equipment, large backpacks). Because many local vehicles utilize trunk space for alternative fuel systems (LPG tanks), un-declared luggage that exceeds vehicle limits may result in the Partner refusing service at the traveler's expense.
  • Driver Wait Times: For airport pickups, standard complimentary waiting time is 60 minutes from flight arrival. For hotel/resort pickups, the waiting time is 30 minutes. Delays beyond these windows may incur hourly wait fees.

  • Partner Ownership: Rental vehicles are owned, maintained, and legally operated by our verified vehicle rental Partners.
  • Driving Restrictions: Certain high-altitude mountain tracks, river crossings, or border zones are strictly off-limits for standard rental cars due to extreme terrain. Violation of terrain restrictions invalidates insurance coverage.

  • Processing Deadlines: Border zone permits (e.g., Kel-Suu, Inylchek) are processed through state authorities. Processing takes up to 4 weeks. MyWay is not responsible for delayed or rejected permits if documents were submitted past deadlines.
  • Non-Refundable Fees: State administrative fees and processing costs for border permits are strictly non-refundable once submitted to the government.

  • Safety & Guide Authority: Mountain conditions in winter change rapidly. Our certified guide Partners have absolute authority to alter, shorten, or cancel itineraries based on avalanche risks or severe weather.
  • Client Equipment: Participants are responsible for ensuring they possess required safety gear (avalanche beacon, probe, shovel) as specified by the guide.

4. Cancellations, Modifications, and Refunds

4.1 Cancellations by the Traveler

Standard cancellation windows and refund eligibilities (minus payment processing fees) vary by service and will be clearly indicated on your provisional confirmation invoice.

4.2 Force Majeure (The Mountain Clause)

Kyrgyzstan features rugged alpine terrain where weather and infrastructure can be unpredictable. MyWay and its Partners are not liable for disruptions caused by sudden mountain pass closures (snow, mudslides, rockfalls), political closures of border checkpoints, or extreme weather hazards. In these cases, MyWay will work to offer an alternate route, reschedule, or provide a partial/full refund depending on expenses already committed by the Partner.


5. Liability Disclaimers

5.1 Partner Liability

Because the services are physically executed by independent Partners, MyWay.kg (and its operating Individual Entrepreneur entity) shall not be held liable for any direct or indirect injury, loss, property damage, delays, or additional costs incurred during the delivery of the service.

5.2 Travel Insurance

We strongly advise all international travelers visiting Kyrgyzstan to obtain comprehensive travel insurance that explicitly covers high-altitude outdoor activities, vehicle accidents, and trip cancellations.
